These Terms & Conditions apply to purchases made through the MALITI 07021 IT online store.

By placing an order with us, you agree to these Terms & Conditions. Any mandatory consumer rights available to you under the laws applicable in your country or place of residence remain unaffected.

2. Products

We take great care to describe and present our products as accurately as possible.

Many MALITI pieces are handcrafted and made using natural materials. Slight variations in colour, texture, grain, dimensions or finish may therefore occur and are part of the individual character of these materials and the handcrafted nature of the product.

Colours displayed on screens may also vary slightly depending on the device and display settings used.

3. Prices and Currencies

Prices are displayed in the currency applicable to the selected country or market where available.

The price applicable to your order is the price shown during checkout before you place your order.

Applicable taxes are displayed or included in accordance with the requirements and settings applicable to the relevant market.

MALITI reserves the right to change product prices at any time. Any price changes will not affect orders that have already been placed and accepted.

4. Orders and Formation of Contract

Products displayed in our online store constitute an invitation to place an order.

By submitting your order through the checkout, you make an offer to purchase the products contained in your order.

After placing your order, you will receive an electronic order confirmation. The purchase contract is concluded in accordance with the applicable checkout process and applicable law.

We reserve the right to decline or cancel an order where there is a legitimate reason to do so, including obvious pricing or technical errors, suspected fraud, inability to deliver to the requested destination, or unavailability of the ordered product.

If payment has already been received for an order that we are unable to accept, the corresponding amount will be refunded.

Available payment methods are displayed during checkout and may vary depending on your country or region.

Payment is processed using the payment method selected during checkout.

Any charges imposed independently by your bank, card issuer or payment provider, including foreign exchange or currency conversion charges, are outside the control of MALITI.

6. Complimentary Worldwide Shipping

MALITI offers complimentary standard worldwide shipping on all orders to destinations that we currently serve.

Available shipping options and any applicable delivery information will be displayed during checkout.

Delivery times may vary depending on the destination, product availability, customs processing and other circumstances outside our reasonable control.

Any delivery dates or timeframes provided are estimates unless expressly stated otherwise or mandatory law provides otherwise.

7. Duties, Import Taxes and Customs

For international orders, customs duties, import taxes and other import-related charges may apply depending on the destination.

Where MALITI offers a destination on a duties-inclusive basis, applicable customs duties and import taxes are included or otherwise covered by MALITI as indicated during checkout, so that the customer is not required to pay those amounts separately upon delivery.

Where duties-inclusive delivery is not available for a particular destination, any applicable duties, taxes or import charges will be clearly addressed during the checkout process to the extent supported by our store and shipping services.

Customs procedures and requirements are determined by the authorities of the destination country and may be outside MALITI's direct control.

8. Delivery

Please ensure that the delivery address provided with your order is complete and correct.

Once your order has been dispatched, you will receive shipping information where tracking is available.

If delivery cannot be completed because an incorrect or incomplete address was provided, or because a shipment was refused or not collected, additional costs arising from a renewed delivery may be charged where permitted by applicable law.

Risk in the goods passes in accordance with applicable consumer law.

9. Returns and Refunds

Our Returns & Refunds Policy forms part of these Terms & Conditions.

You may request a return within 14 days of receiving your order, subject to the terms of our Returns & Refunds Policy and any mandatory statutory rights applicable to you.

MALITI provides complimentary worldwide shipping for the original delivery. The direct cost of returning an item following a standard return or withdrawal is the responsibility of the customer, except where applicable law provides otherwise or where an item is legitimately returned because it is defective, damaged upon delivery or incorrectly supplied.

10. Product Use and Safety

MALITI products must be used for their intended purpose and in accordance with the instructions and safety information supplied with the product.

Certain products, including the MALITI Beach Sun Sail, contain structural and functional components such as bamboo poles, tensioning ropes, pegs, carabiners and other hardware.

These components must be assembled, secured, used and stored carefully and in accordance with the supplied instructions.

The Beach Sun Sail must be securely installed on suitable ground and should not be used in weather or wind conditions in which safe use can no longer be ensured. It should be dismantled when conditions make continued use unsafe.

Poles, pegs, tensioned ropes and other structural components can cause injury or damage if incorrectly assembled, inadequately secured, misused or used for purposes for which they were not designed.

Children should not assemble or dismantle the Beach Sun Sail without appropriate adult supervision and should not play with its structural or tensioning components.

Customers are responsible for following the assembly, use, care and safety instructions supplied with the product.

Nothing in these Terms excludes or limits MALITI's liability where such liability cannot lawfully be excluded or limited, including applicable rights relating to defective or unsafe products.

11. Natural Materials and Handcrafted Products

MALITI works with carefully selected natural materials, including linen and bamboo.

Natural variations in structure, colour, grain and surface are characteristic of these materials and do not in themselves constitute defects.

Similarly, small variations resulting from handcrafted production may occur between individual pieces.

These characteristics are part of the individual nature of a MALITI product and should be distinguished from manufacturing defects or damage.

12. Care Instructions

Please follow the care, cleaning, storage and maintenance instructions supplied with your MALITI product.

Incorrect cleaning, storage, modification or use contrary to the supplied instructions may damage the product and may affect claims relating to damage caused by such treatment, to the extent permitted by applicable law.

13. Liability

MALITI is responsible for its products and contractual obligations in accordance with applicable law.

To the maximum extent permitted by applicable law, MALITI is not responsible for loss or damage resulting from improper use, failure to follow supplied instructions or safety information, unauthorized modification of a product, or use of a product for a purpose for which it was not designed.

Nothing in these Terms & Conditions excludes or restricts liability that cannot legally be excluded or restricted, including mandatory consumer protection rights and applicable product liability rights.

14. Intellectual Property

All content available through the MALITI website, including the MALITI name, trademarks, product designs, photographs, text, graphics and other creative material, is protected by applicable intellectual property laws.

Unless expressly permitted, content from this website may not be reproduced, distributed, modified or used commercially without prior written permission.

Certain MALITI product designs may additionally be protected by registered or unregistered design rights.

15. Privacy

Personal information is processed in accordance with our Privacy Policy.

16. Governing Law and Mandatory Consumer Rights

These Terms & Conditions and contracts concluded with MALITI are governed by the laws of the Federal Republic of Germany, without prejudice to mandatory consumer protection provisions that may apply in the country in which the customer has their habitual residence.

Nothing in these Terms & Conditions is intended to deprive a consumer of mandatory rights or protections available under applicable law.

We may update these Terms & Conditions from time to time to reflect changes to our services, products, business practices or legal requirements.

The Terms & Conditions applicable to an order are those in effect at the time the relevant order is placed.
